Stewards hit Olivieri over TCO2

Stewards have charged top trainer Ross Olivieri with having presented Sandler to race at Gloucester Park when he had a total carbon dioxide level exceeding the legal limit.
Chairman of Racing and Wagering WA stewards John Zucal adjourned an inquiry until September 28 after hearing evidence yesterday.
"Our panel of stewards have considered standing Mr Olivieri down from having starters pending resumption of the inquiry," Zucal said
"But we have decided not to take that action, at this stage."
Olivieri was charged in relation to Sandler testing in excess of 36 millimoles per litre in plasma of TCO2, which reduces muscle fatigue in horses, after he ran unplaced on August 12.
Olivieri pleaded not guilty.
Melbourne-based Racing Analytical Services Ltd's executive David Batty gave evidence by telephone to yesterday's inquiry.
"When we tested the blood sample in question, the TCO2 reading was in excess of 39 mm/l," Mr Batty told the inquiry.
Perth analyst Charlie Russo said the original level tested at the WA Chemcentre was 38.5 mm/l.

Oakford trainer Ross Olivieri, a winner of eight Perth premierships, has been granted a stay of proceedings pending his appeal against a one-year disqualification and is clear to resume preparing a team of more than 30 pacers.
Olivieri, 57, was banned when stewards found him guilty two weeks ago of having presented Sandler to race at Gloucester Park on August 12 with a total carbon dioxide level exceeding 36 millimoles per litre in plasma. Racing Penalties Appeal Tribunal chairman Dan Mossenson yesterday granted Olivieri a stay and said it would stand for three weeks.
"If arrangements have not been made for the appeal to be held within 21 days, application must be made for the stay of proceedings to be extended," Mossenson said.
Olivieri transferred several horses from his team to Byford trainer Peter Tilbrook's stable after the disqualification.
Olivieri said after leaving the appeal he was undecided when he would resume training horses.
"It's up in the air," he said. "I'm still making a decision on whether I'll take the horses back in the weeks leading up to the appeal."
Racing and Wagering WA harness racing stewards chairman Bill Delaney said his panel would immediately clear Olivieri to resume training. "In view of the decision, it is back to business as usual for Mr Olivieri pending the appeal," Delaney said.
Olivieri's legal counsel, Tom Percy QC, told the tribunal yesterday he was adamant the trainer's ban should be lifted.
"Apparatus which had not been approved by Racing and Wagering WA was used at a Perth laboratory to test Sandler's post-race blood sample," Percy said.
"The test results must be overruled and Mr Olivieri does not have a case to answer.
"If police didn't use officially approved breathalysers to test motor vehicle drivers, traffic charges would be dismissed."

and those trainers continue to be allowed to participate in the industry how is that possible how long can appeals on TC02 cases last :?: :?
slipatiptome...as for a comment on the outcome.......hire a QC and Apeal......as yet no penalty applied....keep on racing.......its just not good enough ....

Harness trainer Ross Olivieri had his appeal on a post race TCO2 dismissed today. Decision handed down immediately and 12 months disqualification starts today. Announced on Sky 2.
May be time to start post race testing for TCO2 at gallops as well.
