    Surely "when" the owners appeal the decision to the Racing Penalties Appeal Tribunual and it "is" successful and then gets referred back to the stewards, surely it would/should be heard by a different panel of stewards because the ones that presided over the initial protest would have a conflict of interest and it could be perceived that they are no longer impartial :?:
    As if the protest is over-turned it has the potential to have a direct impact on them.... :think:

    I am told it will only go back if therw has been procedual error and will be before the same panel.

    OK Funkster is this was to happen in side your head in Fairy Land we would need to re-run the race and post the Stewards around the track of the Railways so they can sit in on the the Panel in Fairy Land -Do the Crime do the Time 8)

    it takes a special type of person to be able to write like you are doing.
    they would be about 6 years old and in prep grade, so why are you up so late?
    not to mention you have to be 13 years old or over to post here i thought....were you given special dispensation?

    I didn't think there was much to debate. Damien's pictures are pretty damning, it's a bit hard to debate what is black and white, or enlarged glossy colours in this instance :P

    Surely the only people that could support the decision would be people who either backed the horse, are connected to the horse or don't want to upset anyone at RWWA.

    So if someone got convicted of murder on inconclusive, circumstantial and fabricated evidence would we be saying just let it go?
    A few hypocrites out there imo.....justice needs to be served

    The still photos are anything but conclusive. Even Damien mentioned the person with him at the time who believed the photos supported the Steward's decision--only thing I could get out of his photos was that at one stage HR is against the rails and then he is 1/2 horse wider. The photo where Damien suggests Chui's horse is hard to handle is after the incident when WS has been forced out into him by HR

    I just had a look at Damien's photos and the first of the sequence is well after the field started turning. He's Remarkable moves out just as he hits the turn (well before Damien's photos begin). There's no doubt in my mind that at about the 640m mark when they commence the turn, He's Remarkable shifts out and bumps Waratah's Secret into Big Ted who is put off balance and lays in. The thing is, Waratah's Secret doesn't stumble until about the 560m mark.
    Damien's photos suggest that at the point where Waratah's Secret stumbles badly Big Ted is laying in.
    I would have dismissed the protest even if Big Ted hadn't contacted Waratah's Secret. The shift from He's Remarkable was minor and not blatant and for WS to check that badly, there had to be pressure from the outside.
    Anyway, to lose a race for such a minor shift and indirect interference was a howler imho.

    I was fairly convinced that He's Remarkable was responsible for the entirety of the contact, and although struggled to 100% agree that Luckygray deserved to win the race, I always felt He's Remarkable made the race 'unfair' to it's advantage and in my opinion, didn't 'deserve' to win the race.

    I may have to revise that slightly after viewing the replay a few times!

    Really do think (like the majority) that Big Ted played a part in contributing to that contact, though He's Remarkable in my opinion did just as much.

    I don't know, just had to type out my revised opinion...... but now I'm more confused than before.

    Never let it be said that photographic proof is anything but that. People have left comments saying the horse has moved out or is clearly off its line. Others have come to the conclusion that He's Remarkable didn't impede Waratah's Secret enough.

    With this amount of debate now still going 6 days later, with all having the luxury of time to formulate an opinion, I do feel a bit for the Stewards who felt compelled to make a decision on the day. They were never going to please everyone, no matter what their decision.

    It's just going to be one of those races where everyone will remember it for different reasons.
